Welcome to Wild Slabs ("Platform," "Service," "we," "us," or "our"), operated by DGW Collectibles, Inc. d/b/a DGW Collectibles & Estates. By accessing or using our Platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. OVERVIEW OF SERVICE
Wild Slabs is an entertainment platform that offers users the opportunity to purchase professionally graded trading cards ("Cards" or "Slabs") from a finite, curated inventory pool ("Pool"). Each purchase results in the user receiving one Card assigned from the available Pool for their selected tier.
2. PURCHASES AND SLAB ASSIGNMENT
2.1 Tier Pricing
Each tier is offered at a fixed price as displayed on the Platform at the time of purchase. Prices may vary by tier or promotional period and are subject to change without notice.
2.2 Slab Assignment
Slabs are assigned from a finite, curated inventory specific to each tier. We do not claim equal or independent probability of selection. We do not guarantee any specific outcome, Card value, or return on any purchase.
2.3 VALUE DISCLAIMER - PLEASE READ CAREFULLY
THE VALUE OF YOUR SLAB(S) MAY NOT MEET OR EXCEED THE PRICE YOU PAID FOR YOUR PACK PURCHASE.
Values displayed on Wild Slabs ("Displayed Values") are estimates based on recent market data and are inherently subjective. Displayed Values are provided for informational purposes only and should not be relied upon as accurate representations of actual market value. Values are subject to change without notice and may be volatile.
DGW COLLECTIBLES & ESTATES, INC. EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT:
- (a) The Displayed Values presented for any slab are the same as any other person, dealer, marketplace, or grading service may ascribe to such item at any given time;
- (b) Any slab has any particular value in any third-party marketplace, auction, or private sale;
- (c) You will be able to sell any slab for its Displayed Value or any other amount;
- (d) Displayed Values reflect replacement cost, insurance value, or any other standardized valuation methodology.
YOU ACKNOWLEDGE THAT YOU ARE PURCHASING A PACK WILLINGLY AND WITH FULL KNOWLEDGE OF THE ABOVE INFORMATION REGARDING VALUES. You agree that the entertainment value of the mystery box experience is a material component of your purchase decision.
2.3.1 Minimum Card Valuation
No graded card listed on Wild Slabs is valued below $15. Professional grading alone costs a minimum of $15 per card regardless of outcome, which establishes a practical floor on the value of any graded slab. Displayed values reflect this baseline and are determined by current market data at the time of listing.
2.3.2 Valuation Data Source
All slab market values displayed on Wild Slabs are based on publicly available sales data from PriceCharting.com as of the date the drop is listed. These values are provided for reference only and do not constitute an appraisal or guarantee of current or future market value. Actual resale prices may vary based on market conditions, buyer demand, and other factors outside our control.
2.4 Tier Pool Composition
Each tier contains cards of varying values. As cards are assigned and claimed, the composition of the remaining pool changes. Tiers close when inventory is depleted.
INVENTORY AND AVAILABILITY MAY VARY. THE PLATFORM DISPLAYS AVAILABLE INVENTORY IN REAL-TIME. PREMIUM SLABS ARE LIMITED AND MAY NOT BE AVAILABLE IN EVERY PURCHASE.
2.5 All Sales Final
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE ONCE A SLAB HAS BEEN ASSIGNED.
Because you receive a tangible, professionally graded collectible card with every purchase, no refunds or returns are available. If you are not satisfied with your assigned slab, you may exercise the Trade-In option described in Section 4.3 to receive non-cash store credit equal to ninety percent (90%) of the slab's Displayed Value. Initiating a chargeback or payment dispute in lieu of using the Trade-In option constitutes a violation of these Terms and may result in account suspension or termination under Section 6.4.
3. MARKETING AND PROMOTIONAL MATERIALS
Even if advertising, marketing, promotional materials, social media posts, livestreams, or other statements made by DGW or its representatives include or otherwise reference example cards, "legendary pulls," high-value results, or representative items that have been or may be available to certain customers who purchase packs from time to time:
- (a) Your specific pack is NOT guaranteed to include any particular card, grade, or Pokรฉmon;
- (b) Your specific pack is NOT guaranteed to include a card of any particular value or rarity;
- (c) Past pull results, whether displayed on the platform, social media, or elsewhere, do NOT guarantee or predict future outcomes;
- (d) Example cards shown in promotional materials represent possible outcomes, not expected or guaranteed outcomes;
- (e) Statistical odds or probabilities, if displayed, are estimates and actual results may vary.
NO EMPLOYEE, REPRESENTATIVE, STREAMER, INFLUENCER, OR AFFILIATE OF DGW IS AUTHORIZED TO MAKE ANY GUARANTEE OR REPRESENTATION CONTRARY TO THIS AGREEMENT. Any such statement, whether oral or written, does not constitute a warranty or representation by DGW and should not be relied upon.
4. DGW STORE CREDIT
THIS SECTION CONTAINS IMPORTANT INFORMATION ABOUT STORE CREDIT. PLEASE READ CAREFULLY.
4.1 Nature of Store Credit
DGW Store Credit ("Credit") is non-cash store credit that may be received by users who elect to trade in ("Trade-In") a Card to DGW. Credit is NOT a gift card, stored value card, prepaid card, cash equivalent, or any form of currency.
DGW CREDITS ARE A CLOSED-LOOP STORE CREDIT FEATURE INTENDED ONLY TO FACILITATE TRANSACTIONS ON THE WILD SLABS PLATFORM. CREDITS ARE NOT:
- A bank account, savings account, or deposit account;
- A stored value card or prepaid card;
- A money transmission service or e-money;
- An investment or security;
- Redeemable for cash (except as may be required by law);
- Transferable to other users;
- Interest-bearing.
4.2 No Insurance or Interest
Credits are NOT insured by the Federal Deposit Insurance Corporation (FDIC), the Securities Investor Protection Corporation (SIPC), or any other governmental or private insurance program. You will NOT receive interest or other earnings on Credits held in your account.
4.3 Receiving Credit
When you complete a purchase and a Card is revealed, you may choose to:
(a) Claim the Card โ The Card will be added to your Vault and may be shipped to you at the address on file, subject to our Shipping Policy; or
(b) Trade In the Card โ You may elect to trade in the Card to DGW in exchange for non-cash Store Credit equal to ninety percent (90%) of the slab's Displayed Value at the time of release. This rate is subject to change with notice. The 10% difference represents the platform's service fee and the cost of returning the slab to inventory.
The Trade-In option may be exercised voluntarily at the time of reveal OR from your Vault within seven (7) days of the reveal date. Cards that have been added to a shipping batch cannot be traded in.
(c) Trade-In Window Expiration. The trade-in option for any claimed Card expires seven (7) days after the reveal date. After the trade-in window closes, the Card remains in the user's vault and may be shipped at any time, but the trade-in option is no longer available. A reminder notification will be sent to the email address on file approximately twenty-four (24) hours before the trade-in window closes. It is the user's responsibility to exercise the trade-in option within the 7-day window if they wish to receive Store Credit. Shipping costs, including applicable sales tax, are charged at the time the user initiates a shipping request.
4.4 Credit Terms and Conditions
By receiving or using Store Credit, you agree to the following terms:
- Non-Transferable. Credit is personal to the account holder and may not be transferred, sold, auctioned, traded, gifted, or otherwise conveyed to any other person or account.
- Not Redeemable for Cash. Credit has no cash value and is not redeemable for cash, check, wire transfer, cryptocurrency, or any other form of monetary payment under any circumstances, except as expressly provided in Section 4.6 (Platform Discontinuation).
- DGW Merchandise Only. Credit may only be applied toward the purchase of DGW merchandise, including future tier purchases on the Wild Slabs Platform.
- No Expiration. Credit balances do not expire while your account is active. Your Credit balance will remain available in your account indefinitely.
- Escheatment. Credits that remain unused in inactive accounts may be subject to escheatment (transfer to the state) in accordance with applicable state unclaimed property laws. DGW will attempt to contact you before any escheatment occurs.
- Non-Refundable. Credit cannot be refunded, reversed, or exchanged once issued.
- Account-Specific. Credit is tied to your specific Wild Slabs account.
- Chargebacks and Fraud. DGW may reverse credits for chargebacks, fraud, or policy violations.
4.5 Credit Protection
Credits earned through legitimate purchases and normal platform use will not be forfeited arbitrarily. Forfeiture applies only in cases of documented Terms violations, fraud, or abuse. If you believe your account was terminated in error, you may contact us to appeal.
4.6 Platform Discontinuation
In the event Wild Slabs permanently discontinues the Platform:
- We will provide users with at least thirty (30) days' advance notice via email;
- During the notice period, users may continue to use their Credit balances for merchandise purchases;
- Upon the effective discontinuation date, any remaining unused Credit balances will be forfeited. Credits have no cash value and are not redeemable for cash under any circumstances, including platform closure.
5. SHIPPING AND DELIVERY
Claimed Cards remain in the user's vault until the user initiates a shipping request. Cards may be shipped at any time by adding them to a shipping batch. Shipping costs, including applicable sales tax, are calculated based on order value and destination, and are charged at the time the shipping batch is processed. Shipments are fulfilled within 5-7 business days of the shipping request or Drop closing. The 90% trade-in option is available for seven (7) days from the reveal date; after the window closes, the Card remains in the vault and the trade-in option is no longer available. Risk of loss passes to you upon delivery to the carrier.
Shipping Insurance: Orders valued at $100 or more include additional shipping insurance at 2% of declared value. Insurance covers loss or damage during transit. Claims must be filed within 14 days of expected delivery date.
6. ACCOUNT TERMS
6.1 Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old.
6.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6.3 Automatic Account Hold for Payment Failures
To protect our customers and prevent unauthorized use of payment methods, your account will be automatically placed on hold if three (3) or more payment attempts are declined within a one-hour period. While on hold, you will be unable to make purchases but your existing Credit balance, vault contents, and any pending shipments will remain safe and unaffected. To restore your account, you will need to verify your identity by providing a valid government-issued photo ID and, if applicable, confirmation of your payment method. Verification materials will be permanently deleted immediately after review. You may contact us at [email protected] to initiate the verification process.
6.4 Account Suspension or Termination
We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent activity, or other abuse of the Platform. Upon termination for cause (such as fraud, chargebacks, or Terms violations), any Credit balance may be forfeited.
7. PROHIBITED CONDUCT
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to manipulate or exploit the service
- Create multiple accounts to abuse promotions or Credit
- Transfer or attempt to transfer Credit in violation of these Terms
- Engage in fraudulent chargebacks or payment disputes
- Harass, abuse, or threaten Wild Slabs staff or other users
- Use bots, scripts, or automated systems to interact with the Platform
8. DISCLAIMER OF WARRANTIES
THE SERVICE, PLATFORM, AND ALL SLABS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DGW EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- (a) THE IMPLIED WARRANTY OF MERCHANTABILITY;
- (b) THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE;
- (c) THE IMPLIED WARRANTY OF NON-INFRINGEMENT;
- (d) ANY WARRANTY ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE;
- (e) ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
- (f) ANY WARRANTY REGARDING THE ACCURACY OF DISPLAYED VALUES OR MARKET DATA;
- (g) ANY WARRANTY REGARDING THE CONDITION, GRADE, OR AUTHENTICITY OF SLABS BEYOND THE GRADING COMPANY'S OWN WARRANTY.
DGW does not warrant that any slab will maintain its current grade, condition, or value over time. Grading is performed by third-party services (PSA, CGC, TAG, etc.) and DGW makes no independent representations regarding grades.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
8.1 No Investment Advice
Wild Slabs is an entertainment platform, not an investment service. Nothing on this Platform constitutes investment, financial, tax, or legal advice. DGW is not a registered investment adviser, broker-dealer, or financial planner. DGW is not a fiduciary to you by virtue of your use of the Service.
There are inherent risks associated with purchasing, holding, and selling collectibles, including the risk of total loss. A collectible's past value or performance is not a guarantee or indication of future value or performance. You alone are responsible for evaluating the merits and risks of any purchase.
8.2 Card Authenticity
All Cards are professionally graded by third-party grading services (PSA, CGC, TAG, etc.). Wild Slabs does not independently authenticate Cards and relies on the grading services' determinations.
8.3 Responsible Spending
Mystery packs are entertainment products. We encourage responsible spending practices: only spend what you can comfortably afford, set personal budgets, and take breaks if collecting stops being enjoyable. If you feel your spending is becoming problematic, please reach out to a financial counselor or the National Foundation for Credit Counseling (NFCC) at 1-800-388-2227.
9. LIMITATION OF LIABILITY
9.1 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DGW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, punitive, or exemplary damages;
- Loss of profits, revenue, data, goodwill, or business opportunities;
- Cost of procurement of substitute goods or services;
- Business interruption or loss of use;
- Intangible losses;
- Personal injury or emotional distress;
- Intrinsic, sentimental, or collector value of any slab beyond its Displayed Value;
ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF DGW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2 Cap on Liability
THE MAXIMUM AGGREGATE LIABILITY OF DGW AND THE DGW PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:
- (a) The amount you actually paid to DGW for the specific transaction giving rise to the claim; or
- (b) One Hundred Dollars ($100.00 USD).
9.3 Essential Purpose
You acknowledge that DGW has set its prices and entered into this Agreement in reliance upon the limitations of liability and disclaimers of warranties set forth herein, and that the same form an essential basis of the bargain between the parties.
9.4 Jurisdictional Limitations
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless DGW Collectibles & Estates, Inc., its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers (collectively, the "DGW Parties") from and against any and all claims, actions, demands, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- (a) Your breach of this Agreement or any representation or warranty contained herein;
- (b) Your violation of any applicable law, regulation, or third-party right, including intellectual property rights;
- (c) Your negligence, willful misconduct, or fraud;
- (d) Any dispute between you and any third party regarding a slab, transaction, or the Service;
- (e) Any chargeback, payment dispute, or fraud claim initiated by you or your financial institution;
- (f) Your tax obligations or failure to comply with tax reporting requirements;
- (g) Any claim that your use of the Service caused damage to a third party.
In the event of any claim subject to indemnification, DGW shall have the right, at its sole discretion, to select its own legal counsel and to control the defense and/or settlement of any such claim. You shall cooperate fully with DGW in asserting any available defenses.
This indemnification obligation shall survive termination of your account and this Agreement in perpetuity.
11. DISPUTE RESOLUTION AND ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
11.1 Informal Resolution First
Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within sixty (60) days of submission, you or DGW may initiate formal proceedings as described below.
11.2 Binding Arbitration
If we cannot resolve a dispute informally, all claims arising out of or relating to this Agreement or the Service (including its formation, performance, and breach), except as set forth in Section 11.6, shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with the Consumer Arbitration Rules then in effect.
Arbitration shall be conducted in Poughkeepsie, New York, or, at your election, via telephone or video conference. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Agreement, including any claim that all or any part of this Agreement is void or voidable.
11.3 Arbitration Fees
DGW will pay all AAA filing fees, administration fees, and arbitrator fees for any arbitration we initiate. For arbitrations you initiate, we will pay all such fees that exceed $200. If the arbitrator finds the arbitration to be frivolous or brought for an improper purpose, you agree to reimburse DGW for all fees paid on your behalf.
11.4 30-Day Opt-Out Right
YOU MAY OPT OUT OF THIS ARBITRATION AGREEMENT.
If you do not wish to be bound by this arbitration provision, you must notify DGW in writing within thirty (30) days of first accepting this Agreement by sending an email to [email protected] with the subject line "Arbitration Opt-Out" that includes your name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all other provisions of this Agreement will continue to apply.
11.5 Class Action and Jury Trial Waiver
YOU AND DGW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Unless both you and DGW agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or private attorney general proceeding.
YOU ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING THE RIGHT TO PARTICIPATE IN A CLASS ACTION AND TO A TRIAL BY JURY.
11.6 Small Claims Court Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court in Dutchess County, New York, or the small claims court of your county of residence, provided the claim qualifies for small claims court jurisdiction.
11.7 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
11.8 Severability
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision shall be severed, and the remaining arbitration terms shall be enforced.
12. TAX MATTERS
12.1 Your Responsibility
You are solely responsible for determining and paying any taxes applicable to your use of the Service, including income taxes, sales taxes, use taxes, and any other applicable taxes.
12.2 Tax Information
We may require you to provide tax identification information (such as a Social Security Number or EIN) in connection with your use of the Service. If you fail to provide requested tax information, we may suspend your ability to make purchases or receive shipments.
12.3 Reporting
DGW may be required to report certain transactions to the Internal Revenue Service or state tax authorities. By using the Service, you authorize DGW to report as required by law.
12.4 No Tax Advice
DGW does not provide tax advice. Consult a qualified tax professional regarding the tax implications of your transactions.
13. MODIFICATIONS TO TERMS
We may modify these Terms at any time by posting the revised Terms on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. We will notify you of material changes via email or prominent notice on the Platform.
14. FORCE MAJEURE
DGW shall not be liable for any delay or failure to perform any obligation under these Terms resulting from causes outside its reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of war or terrorism, government actions or orders, labor disputes, carrier delays or failures, internet or telecommunications disruptions, power failures, fire, flood, or supplier shortages. In the event of a force majeure, DGW's obligations shall be suspended for the duration of the event, and DGW shall use commercially reasonable efforts to resume performance as soon as practicable.
15. ELECTRONIC COMMUNICATIONS CONSENT
By creating an account on Wild Slabs, you consent to receive electronic communications from DGW, including but not limited to: transactional emails (order confirmations, shipping notifications, trade-in confirmations, trade-in window reminders), account notifications (security alerts, password changes, payment method updates), and promotional messages (drop announcements, new features, special offers). You may opt out of promotional messages at any time by using the unsubscribe link in any promotional email. You may not opt out of transactional or account-related communications while your account is active, as these are essential to the operation of the Service.
16. GENERAL PROVISIONS
16.1 Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
16.2 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DGW regarding the Service and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied. No statement, representation, warranty, covenant, or agreement of any kind not expressly set forth in these Terms shall affect, or be used to interpret, change, or restrict the express terms of these Terms.
16.3 Waiver
The failure of DGW to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by DGW. No waiver shall be deemed a further or continuing waiver of such provision or any other provision.
17. SURVIVAL
The following sections shall survive termination of your account or this Agreement: All Sales Final (2.5), Value Disclaimer (2.3), Marketing Disclaimer (3), Credit Terms (4), Disclaimer of Warranties (8), Limitation of Liability (9), Indemnification (10), Dispute Resolution and Arbitration (11), Tax Matters (12), and General Provisions (16).

BY USING WILD SLABS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER.
